Website Network Terms and conditions

Quick update:-  In case you had not noticed, all our sites are being re-designed at present to work more quickly on mobile internet systems, such as Mobile Phones and to add extra options and systems, such as the RSS feeds. This work will be taking place over 2008 and will not affect your advert, if you have one with us. In fact, we are looking at increasing advertisers' exposure options, also new options for free members to use! So over the redevelopment process, if you have any ideas that you would like us to look at, from RSS Feeds, through to audio and video options, then please let us know. We will then look at the feasibility of adding your suggestions. Many advertisers are already aware, but if not we would like to point out that PCBT Photography is re-branding and going to Ltd. to portray what it is now doing. PCBT Photography is still being used as the trade name, but the main business name is changing to PBT Media Relations Ltd. The adverts, hostage plans and PR packages are being changed, as a result, to a new billing system. Invoices are being changed to carry the new name PBT Media Relations Ltd, if you pay by credit card via the phone. Our terms and conditions will mainly remain the same overall, but we are adding extra information to cover you on the multi-media section of our advert systems and hostage plans. This is to cover the introduction of a new editable system, to be added to the sites later in 2008. It will not affect current advertisers on the current advert plans.         11 January 2008

General Site Access Terms

A]

Access to and use of Southport Reporter, Mersey Reporter, Liverpool Reporter, Formby Reporter and Southport.TV, both within the UK and internationally, is provided by the PCBT Photography and PBT Media Relations Ltd. on the following terms:-

A1] By using our services you agree to be bound by these terms, which shall take effect immediately on your first use of our websites. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute.

A2] You agree to use our PCBT Photography and PBT Media Relations Ltd. services for lawful purposes only.

A3] All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on and all content (including all applications) located on the site shall remain with PCBT Photography, PBT Media Relations Ltd. or the contributor.

A4] You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use any content in any way except for your non-commercial educational use.

A5] You also agree not to adapt, alter or create a derivative work from any material found on Southport Reporter, Mersey Reporter, Liverpool Reporter, Formby Reporter and Southport.TV, except for non-commercial educational use. Any other use of material/content requires the prior written permission of the PCBT Photography and/or PBT Media Relations Ltd.

A6] The names, images and logos identifying the Southport Reporter, Mersey Reporter, Liverpool Reporter, Formby Reporter and Southport.TV or third parties and their products and services are subject to copyright, design rights and trade marks remain under UK law.

A7] No payments will be given for loss of data, on free sections.

Submission of articles and material

B]

B1] Any email sent to us with a story will be taken as a free press release. Via sharing any contribution (including any text, photographs, graphics, video or audio) by email, post or other any other means, with PCBT Photography and PBT Media Relations Ltd., you agree to grant to the PCBT Photography and PBT Media Relations Ltd., free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons). In certain circumstances we may also share your contribution with third parties. Third parties are all reputable national, local and foreign news broadcasters, internet and print media. Only prior agreed payments for any other third party contributions to Southport Reporter, Mersey Reporter, Liverpool Reporter, Formby Reporter and Southport.TV, will be entertained by PCBT Photography and PBT Media Relations Ltd.

B2] Copyright for your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it unless we have paid you for it. If we have paid for a contribution, this might not be the case, so please check your written contracts, as they may contain contrary arrangements. (Also see B7])

B3] We will endeavour to show your name with your contribution if asked to and/or unless you request otherwise. For operational reasons this is not always possible.

B4] PCBT Photography and PBT Media Relations Ltd. may need to contact you for administrative or verification purposes in relation to your contribution, or in relation to particular projects. For full details of when and how we may contact you, please see our Privacy Policy, plus any local terms where applicable.

B5] Please do not endanger yourself or others, take any unnecessary risks or break any laws when creating content you may share with us.

B6] If you do not want to grant the PCBT Photography and PBT Media Relations Ltd. the permission set out above on these terms, please do not submit or share your contribution in anyway with us.

B7] Any contribution, once published, it will stay published online for as long as PCBT Photography and/or PBT Media Relations Ltd. feel necessary. It might also be published as hardcopy or used in other multi media applications.

Advertisement Clients and Free Community Rules

a.

a1. Carrying an advertisement banner or having an advert in any form on any PCBT Photography and/or PBT Media Relations Ltd. websites does not mean you can say that you are a main sponsor. Section c2. might apply. Also your advert will be removed and no refund will be given. You might be required to pay damages!

a2. PCBT Photography and PBT Media Relations Ltd. reserves the right, to reject, refuse to post or remove any material (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the their Services at any time, if you have been found to have breached the Terms and Conditions on this page.

a3. PCBT photography and PBT Media Relations Ltd. reserves the right to change or amend any of the terms and conditions at any time. You agree to be bound to any changes to this agreement when you use the Services on Southport Reporter, Formby Reporter, Mersey Reporter and Liverpool Reporter, PCBT Photography, PBT Media Relations Ltd. websites, after the modification has been posted for one month. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

a4. Payment of accounts shall be due no later than 30 days from the end of the month in which the invoice was issued. Interest will be charged weekly in advance on overdue payments at a rate of 2% above the base rate of HSBC Bank, starting the first day that payment becomes overdue. Non-account holder's payment will be due up front, unless alternative arrangements have been made in writing.

a5. You agree to this, section a5. for Eligibility for client registration, on all services, including non-paid for services. By using the PBT Media Relation Ltd. and PCBT Photography services, you accept that:-

a) all registration information you submit is truthful and accurate

b) you will maintain the accuracy of such information

c) you are 16 years of age or older, unless agreed to by PBT Media Relation Ltd. and PCBT Photography in writing.

d) your use of the PBT Media Relation Ltd. and PCBT Photography services does not violate any applicable law or regulation.

e) That the use of and membership is void, where any prohibited systems accessed.

a6. You may terminate your Memberships and Adverts at any time, for any reason, but in respect of paid adverts being terminated before full run of contract, payment will not normally be refunded. If however, deemed appropriate by PBT Media Relations Ltd. and/or PCBT Photography, a refund or part payment might be considered.

a7. Illegal and/or unauthorised use of the any part of Southport Reporter, Mersey Reporter, Liverpool Reporter, Formby Reporter, Southport.TV and PCBT Photography websites, including collecting usernames and/or email addresses of members or clients by electronic or other means, for the purpose of sending unsolicited email or unauthorised framing, is prohibited. Appropriate legal action will be taken for any illegal or unauthorised use of the services.

a8. If anyone is aware of misuse of any of our services, please contact us via emailing news24@merseyreporter.com

a9. PCBT Photography and PBT Media Relations Ltd. assumes no responsibility or liability for any material supplied via an advert client.

a10. PCBT Photography and PBT Media Relations Ltd. assumes no responsibility or liability for any material/content supplied via any free member.

a11. No inappropriate (e.g. vulgar, offensive etc) user names must be registered for any services, free or paid!

 Advert banners and advert pages:-

b1. All adverts are sold under PBT Media Relations Ltd. and activation of the adverts will start on complication of agreed payment plan and run by PCBT Photography for PBT Media Relations Ltd. who own the rights to the advertisements embedded on Southport Reporter, Mersey Reporter and Liverpool Reporter.

b2. All Banners and advert pages are subject to approval. When approved, the banner and/or advert page will be added within 7 working days!

b3. All banners are to be paid for prior to approval, if set up via the Internet submission service.

b4. Advert banner sizes:- Adverts sizes. ALL standard banners must be these dimensions:- Width 468 pixels Height 60 pixels

b5. No banners are allowed bigger than 40 bytes unless agreed by PCBT Photography in writing in advance.

b6. Southport Reporter, Mersey Reporter and Liverpool Reporter self-editable advert pages may modified by the use of HTML and/or Flash in the main text field (Not business name section or contact information sections). We do not accept responsibility for the code not working, should you use your own code.

b7. JavaScript is not allowed, unless agreed to by PCBT Photography. Please contact PCBT Photography for more information.

b8. All images uploaded must by jpg. You can add more via inserting html, but do not use HTML to cover advertisements / headers and other sections of Mersey Reporter, Southport Reporter or Liverpool Reporter. Mistakes do happen, so a warning will be issued on the first breach of the rules and the offending material removed. If it happens again, your advert can be removed without refund.

b9. All non self-editable adverts must be paid up front. Payments will only be refunded if PCBT Photography or PBT MEDIA Relations Ltd deemed the advert unsuitable, at time of first submission. We will allow a few changes to be made, if deemed appropriate by us.

b10. You have taken note of f1.

 Removal of adverts:-

c1. WARNING:- If any client is found to be breaking UK law or international law, we will inform the authorities immediately on discovery of the act/s.

c2. All products and services must comply with UK trade rules. Any product or service not found to be in compliance will be removed. No refund will be given. A prior warning will only be issued at the discretion of PCBT Photography and/or PBT Media Relations Ltd. before removal of offending banner/information. Ref:- see www.asa.org.uk.

c3. Any banner that has links to or contains or is found to be, harmful, misleading, offensive, containing pornography, nudity will be removed and no refund will be given. A warning will only be issued at PCBT Photography and/or PBT Media Relations Ltd.’s discretion, before removal.

c4. Any links or banners with child porn on will be removed and no refund will be given. The authorities will be contacted immediately on discovery!  A warning will only be issued by PCBT Photography and/or PBT Media Relations Ltd.’s discretion, before removal.

c5. Tobacco advertisement/s are not allowed and if found they will be removed and no refund will be given. A warning will only be issued at PCBT Photography and/or PBT Media Relations Ltd. digression before removal.

c6. If an advert is not paid for or the client fails to keep up payments when in payment plan, the advertisement/s can be removed. No refund will be given on any money received before removal of the advert. A warning will be issued by PCBT Photography and/or PBT Media Relations Ltd. before removal, only if with in the agreed display running time.

c7. If the business closes down (cease trading) then the advert will be suspended from public viewing as soon as closure is found out by PBT Media Relations Ltd. and/or PCBT Photography, and the following applies:-

a) If the business that has closes down (cease trading) and is not re-opened, with in the payment period, and if payments are up to date, the advert can be changed to another client if requested in writing. If the self-editable advert is not passed on within 1 month, of the closure, it will be removed. A token refund of part of the payments received will only be given to self editable advert plans, at the discretion of PBT Media Relations Ltd. and/or PCBT Photography if not passed on.

b) If the business closes down (ceases trading) and has non-editable adverts will be suspended for 1 month, if payments are up to date. The advert can only be passed on to a client using the same name. Alteration will be made only at the discretion of PBT Media Relations Ltd. and/or PCBT Photography. If not passed on, then the advert will be removed. No other refunds will be given.

{Section c7. is designed to keep our directory up-to-date and stop wastage of advert opportunities for trading businesses.}

c8. Any material supplied as news release, advert inclusion and/or by client is taken is taken to be that the copyright belongs to the sender. If found not to be so, action will be taken against the sender, if deemed appropriate by PBT Media Relations Ltd. and/or PCBT Photography.

c9. If any client is found to be using copyrighted material and they do not have written permission for the material, after an initial warning, it will be removed! A warning will only be issued by PCBT Photography and/or PBT Media Relations Ltd. This breach will only be accepted once, after that PCBT Photography and/or PBT Media Relations Ltd. will charge £10 administration fee to remove the offending material, and/or send warnings and if the administrative fee is not paid in full. Removal of the advert will take place and no refund will be given. Authorities may also be informed.

c10. If a major breach of the Copyright Law is found, a warning will only be issued by PCBT Photography and/or PBT Media Relations Ltd. digression before removal of the advert. No refund will be given. Authorities might also be informed.

c11. Your advert may be deleted and your Membership may be terminated without warning, if we believe that you are under 16 years of age and we have not agreed to it. Refund will be at the discretion of PBT Media Relations Ltd. and/or PCBT Photography.

c12. Selling of any of our advert services is not allowed and will result in removal of the advert immediately without refund.

Copyright:-

d.

d1. The copyright and negatives and digital images remain the property of PCBT Photography, unless otherwise agreed in writing by PCBT Photography.

d2. All text produced by PBT Media Relations and PCBT Photography remained the copyright of PCBT Photography and PBT Media Relations.

d3. Uploading of material by clients. All material uploaded, must comply with UK copyright Laws. See Removal of Adverts C8. & C9.

d4. Using Trade Marks of businesses, without permission, result in a breach of copyright and section c2. and c8. will be taken into account, before any action is taken.

d5. In accordance with the 1988 Copyright and Design Act, where photographs or designs are reproduced, after permission has been gained from PCBT Photography (Patrick Trollope) in writing, a credit must appear mentioning PCBT Photography. Failure to do so in the absence of any other agreement in writing, will result in additional charges being made. This credit can be dropped, but only through written agreement from PCBT Photography (Patrick Trollope).

d6. Failure to comply with UK Copyright Law will result in legal action being considered and the authorities being informed.

 Data Protection:-

e1. In order to participate in and contribute to selected PCBT Photography and PBT Media Relations Ltd. communities, both paid and free sections, you may be required to register with us. Any personal information supplied to PCBT Photography and/or PBT Media Relations Ltd. as part of this registration process and/or any other interaction with PCBT Photography and/or PBT Media Relations Ltd. will be collected, stored and used in accordance with the UK Data Protection Act.

Passwords:-

f1. When you sign up to become a Member or a client, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify PCBT Photography and/or PBT Media Relations Ltd. immediately if you suspect any unauthorised use of your account or access to your password.

f2. You are solely responsible for any and all use of your account/s.

Phone and office Credit Card Payments:-

g1. Credit Card Payments, if taken on phone or through the offices in Southport, might show as PCBT Photography / PBT Media Relations Ltd. PCBT Photography and PBT Relations are not the same, but are working together. See b1. PCBT Photography operates Southport Reporter, Liverpool Reporter and Mersey Reporter for PBT Media Relations. PBT Media Relations are the advertisement agents only and will deal with the advertisements of the advertisers and take payment and conduct the billing of all PCBT Photography clients and their own clients.

g2. Photographs can be ordered through either PCBT Photography or PBT Media Relations Ltd. but all photographs ordered must be declared for personal use, unless except where contracts contain contrary arrangements. Also:-

a) Payments made for photographs via PCBT Photography (Patrick Trollope), excepting contracts containing contrary arrangements, fees paid to PCBT Photography (Patrick Trollope), will be for the sole specified use of the image/s; additional usage must be paid for separately at the appropriate rates. See d5. It will be made clear on the invoice and on entering into the sale, before the billing that it will be via PCBT Photography (Patrick Trollope) and not PBT Media Relations Ltd.

b) Payments for photographs via Credit Card Payments, if taken on phone or through the offices in Southport, will be taken though PBT Media Relations Ltd. accounts and This will be made clear on the invoice and in entering sale, before the billing. Excepting contracts containing contrary arrangements, fees paid to PBT Media Relations Ltd. will be for the sole specified use of the image/s, additional usage must be paid for separately at the appropriate rates. See d5.

c) No images purchased from PBT Media Relations Ltd. and/or PCBT Photography can be reproduced without the permission of PBT Media Relations Ltd. or PCBT Photography, unless contracts contain contrary arrangements.

Non-commercial PCBT Photography and PBT Media Relations Ltd. Free Community Rules:-

h.

h1. You agree to use PCBT Photography and/or PBT Media Relations Ltd. free communities (including message boards, games and live chats) in accordance with the following Community Rules. These apply across all PCBT Photography and PBT Media Relations Ltd. community sites and services. You should, however, read the local house rules of the particular site or service you're using, as there may be some local variations to these Free Community Rules.

All users of take note of the following:-

a) Non-commercial use by members. Some services are for the personal use of members only and may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by PBT Media Relations Ltd. and PCBT Photography.

b) Unauthorised commercial advertisements, affiliated links, and other forms of solicitation may be removed from member Non-commercial section without notice and may result in termination of membership privileges. Appropriate legal action will be taken for any illegal or unauthorised use of the services.

c) Free selling or otherwise transferring your free profile is not allowed and will result in removal of the profile.

d) See h2 and h6.

e) Contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.

f) Contributions must be lawful, with no disruptive, offensive or abusive behaviour. This includes unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material and is not acceptable.

g) Contributions can be used in reports or as reports as they are regarded under section B1]

h) Be patient as users of all ages and abilities may be taking part.

h2. You agree that any free membership account holders and users of other free interactive service on Southport Reporter, Mersey Reporter and Liverpool Reporter, will choose carefully the information you posted. Any postings made may not include the following items:- your telephone number/s, your street address/es, last name/s, this is for your own safety. We cannot be held responsible for the actions of any member who does.

h3. Free members can not post any photographs containing nudity. Also you can not post any writing or photographs that contains obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.

h3. Free members, as paid advert and services members (see c3.), cannot post any photographs containing nudity. Also you cannot post any writing or photographs that contains obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.

h4. URLs (web site addresses) can only be posted if allowed under any relevant local house rules.

h5. Deliberate misuse of the complaints facility is not permitted. If you persist in doing this, action may be taken against your account.

h6. No spamming or off-topic material:- We don't allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas on any section of our sites.

h7. Contributions containing languages other than English may be removed unless allowed in the relevant local house rules.

h8. Removal of any free service can be made without any warning.

h9. You have taken note of section f1.

i1. All users are aware that IP addresses are logged and information can be passed on to the authorities should it be deemed necessary. Also see e1.

i2. Despite prohibition of material that may cause offence with in our sites, information provided by advertisers and free members (for instance, in their profiles or live chat posting) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services. If found to be the case, we need your help to stop it. Please email us to news24@merseyreporter.com - Thank you. By using and/or viewing our websites you agree to help us enforce this agreement.

i3. PCBT Photography and PBT Media Relations are not responsible for the content of external internet sites. We do our best to check all external internet sites, but as sections are archived, some might become inappropriate. If you do find a site that does cause you offence, please inform us via news24@merseyreporter.com and we will check it and if we agree with your findings, we will remove it. By using and/or viewing our websites you agree to help us enforce this.

i5. You acknowledge that the following words are related to:-

a) Reader, User, Contributor, Your, You, Sender, Subscriber, Member = the client (you).

b) We, Us = PCBT Photography and PBT Media Relations Ltd.

c) PCBT Photography (Patrick Trollope) = Patrick Trollope trading as PCBT Photography.

d) Southport Reporter, Mersey Reporter, Liverpool Reporter, PCBT Photography = Patrick Trollope trading as PCBT Photography.

e) Advertisers = The client of a paid submission or holder of an advertisement/s and/or advertorial

 Charges for PCBT Photography and PBT Media Relations Ltd. Client services (Adverts)

j.

j1. All quotations and charges are based on information supplied by client in written form. Additional work will be charged accordingly.

j2. Dishonoured cheques will incur an additional charge of £15.00 and the full costs of any additional charges.

j3. After the release of the first reminder, subsequent reminders will incur a charge of £6.00 administration fee and a further £2.00 per item. This can be wavered only by Patrick Trollope or PBT Media Relations, depending with whom the contract is with.

j4. Photographs, Graphics, Art Work, Text etc. sent out for approval and not returned within 30 days, will be deemed to be purchased and charges will be issued accordingly.

j5. PCBT Photography and PBT Media Relations Ltd. have the right to demand payment in full for the work carried out, and the contract terminated, if a client is found to be breaking copyright and/or putting PCBT Photography and or PBT Media Relations Ltd. into disrepute. Further action may be taken. Also see sections g. and c.

j6. The failure or delay of PCBT Photography and PBT Media Relations Ltd. to exercise or enforce any right in these terms does not waive the PCBT Photography and PBT Media Relations Ltd. right to enforce that right subsequently.

j7. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

j8. These terms shall be governed by and interpreted in accordance with the laws of England and Wales, which shall have exclusive jurisdiction over any disputes.

j9. All prices quoted on our websites are subject to change.
